
On Wednesday, in their first abortion case in five years, the Supreme Court will hear arguments on a New Hampshire parental notification law. New Hampshire imposes a 48-hour waiting period after the required notice to at least one parent. The law allows for an exception if the mother’s life is in immediate physical danger. However, there is no exception for non-life threatening dangers. The two lower courts declared the law unconstitutional.
The second question the court will consider is whether federal courts can bar the enforcement of abortion restrictions that have not gone into effect, and cannot be said to have injured a plaintiff.
This case is Chief Justice John Roberts first chance to do what we know he’s going to do. Vote for more restrictions on a woman’s right to choose. Or to vote for the sanctity of life. Take your pick.
